These Terms of Service ("Terms") govern your access to and use of the Bite & Balance application and related services provided by Bite & Balance LLC. By accessing or using our service, you agree to these Terms.
You must be at least 13 years of age to use the App. By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. Users under 18 must have parental or guardian consent.

THE BITE & BALANCE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. Content in the App is for informational and wellness purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any diet, fasting regimen, or weight management program, especially if you have a pre-existing medical condition.
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Bite & Balance LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
We reserve the right to suspend or terminate your account if you materially breach these Terms. For free accounts: termination may occur with or without notice depending on the severity of the breach. For paid subscribers: we will provide at least 30 days' written notice before termination, except in cases of serious breach including fraud, illegal activity, harassment of other users, or security threats — in which case immediate suspension may occur. Where a paid subscriber is terminated without fault on their part, a pro-rated refund of prepaid fees will be issued. Upon termination, your license to use the App will immediately cease. You may delete your account at any time through the App settings or by contacting hello@biteandbalance.app.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITE & BALANCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction therein.
We may modify these Terms at any time. We will provide notice of material changes through the App or via email. Your continued use after the effective date constitutes acceptance of the modified Terms.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. For users located in the United States: except for claims seeking injunctive or equitable relief, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Delaware or via remote hearing. You waive the right to participate in class action lawsuits or class-wide arbitration. Each party shall bear their own arbitration costs, except as required by AAA rules. Opt-out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@biteandbalance.app with the subject line 'Arbitration Opt-Out'. For users located outside the United States: disputes shall be resolved by the courts of competent jurisdiction in your country of residence, and this arbitration clause does not apply to you.
Bite & Balance LLC shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, infrastructure or internet outages, cybersecurity incidents affecting third-party services, pandemics or public health emergencies, or any other event of force majeure. We will endeavour to resume normal service as quickly as practicable and will communicate any significant outages through the App or our website.
